תוס' ד"ה עשה

He mortgaged his slave and sold him, etc. - עשה עבדו אפותיקי ומכרו כולי

One can collect from a sold עבד who was an אפותיקי even if it was a מלוה ע"פ.

His ox was mortgaged and he sold it, etc. - שורו אפותיקי ומכרו כולי

Summary:
הקדש can be מפקיע מידי שעבוד even if he was מקנה מטלטלין אגב קרקע, but מכר cannot.

We write in a שטר הרשאה that ‘I gave him ד"א in my חצר’; either because everyone has ד"א in א"י (the view of the 'אומרים'), or because הודאת בע"ד כמאה עדים דמי (the ר"ת).
