תוס' ד"ה רעהו

The Merciful one said; ‘his friend’ - רעהו אמר רחמנא

Summary:
The exemptions from שבועה וכפל by הקדש (and קרקעות, etc.) can be derived from one פסוק. the word רעהו excludes הקדש, but איש does not.

For we expound each one as a Klal uPratt by itself - דהא כל חד וחד דרשינן כלל ופרט באפי נפשיה

Summary:
We expound each פרט individually when either there is an extra word (like על) accompanying each פרט, or where all the פרטים save one are superfluous.

Why do I need it - למה לי

Summary:
The (פרטים of כסף וכלים in the) פסוק of כי יתן comes to teach us מה כלים שנים, etc., even for כפל (but not for a כופו"כ). The פסוק of על כל דבר פשע teaches us that everything besides קרקעות עבדים ושטרות ודבר שאינו מסויים is included for שבועה וכפל.

When the ברייתא used the term כופו"כ it was not exact, since it is a ריבוי מיעוט ורבוי; it merely used the more commonly accepted דרשה.

Something which is not specific - דבר שאינו מסויים

Summary:
A דבר שאינו מסויים according to רש"י is something without a סימן, and according to תוספות it is either something which is not a דבר שבמדה, etc. Or it is not a דבר שלם; a חצי רימון, etc. We cannot derive the exclusions of a טוען טענת גנב and a גנב from each other.
